Dear Sir or Madam,
On the 21st of December you seem to have sent me an unsolicited email. A printout of the email is included.
As far as I am aware I did not give your company permission to send me advertising material. Therefore, under Regulation 30 of the Privacy and Electronic Communications (EC Directive) Regulations 2003, I wish to claim compensation from you.
You will be aware of the recent case of Nigel Roberts who, using the new laws, successfully sued a company through the small claims court for sending him unsolicited email. The company were forced by the court to pay Mr Roberts a total of £270 plus his court-filing fee of £30.
I now intend to take similar legal action against your company. However, I would like to offer you this opportunity to settle the matter outside of court so as to avoid unnecessary legal expenses.
I will now wait two weeks for you to either:
Make an offer for an out of court settlement.
OR
Provide evidence that I gave you my permission to send me marketing emails and in accordance with the Data Protection Act (1998) inform me of the source of information you hold about me.
